Hep B shot

my son is 5 months old and i have held the hep b shot but the last time i was at the doctor with him we were talking about vaccines and my pediatrician took out his vacc sschedule and told me he had it in the hospital now no one asked me if thats what i wanted nor did they send me home with that little pink paper saying what shots he got...What can i do i DID NOT want him to het the hep b until much later is there anything legal i can do or should i just file a complaint??

It depends on the state you live in. Vaccination laws differ from state to state and some state that you have to get your child vaccinated before they attend child care/school so, if you didn't you would not be sending your child to school... which is in violation of another law.



However, you could make the argument that you did not provide INFORMED CONENT because you were not told that your child would be receiving the vaccine and you were not informed of the risks or benifits of the vaccine before it was administered. There are two types of consent. One is that you are verbally told what is going on or that you have it in writing, the other is implied consent which is like when you roll up your sleve to get an injection. From what you have said, you did not give any concent so there is a good possibility of making a case against the hospital for administrating a vaccine to your son that you were unaware of, therefore denying you of your right to give informed concent to the person that administered the vaccine.



You have 2 years from the date the act was commited to file a law suit against the hospital.

thank you im not sure the laws here i have no problem giving the shot for school but i was following the dr sears vacc schedule and he delays heb for a while so i was not told about the shot or asked about it..but im not sure how to go about it would you know...do i go to a layer or just to the hospital??? thx for the advise...
