Using my sons leagal name to enroll him in school

I have a 4year old son thatjust started going to a private pre K. His dads mom signed him up and is paying 100% for the tuition. My only issue is when i went to pick him up from school i saw that everyhting is in my sons dads last name... My son has only my last name,,, im upset and i was wondering if there are any laws reguarding using a childs legal last name..
Am i over reacting?
and how should i confront her about this?

by law you have to use his legal last name we wanted to use my last name when my daughter went into kind but because her legal last name was diffrent we couldnt use mine unless we were to go back to court .
