Behind on Child Support and Taxes?

My X husband is behind on child support. He lost his job and hasn't paid a dime in six months and it will be more by the end of the year. We are currently in court so it's unknown to the amount it will be determined he owes? But he owes enough I know that. How is it determined when they will take his taxes and you receive the tax check when they are behind? Do I need to contact the state or a certain department? I want to make sure my children get what they deserve.

My child was 2 when his dad left. Our divorce was final and when son was age 4 X left area. He was a dead beat dad for next 7 yrs. In divorce decreee it listed the minimum for the state of what he had to pay. He was also suppose to cover the health insurance which he never did. I would get money here and there. My son is now 21 and X is still over 20 grand behind. He is suppose to pay arrearages and I don't evenmget the minimum amount on that either. I am lucky if I get something in 3 mos-1yr.
He has now moved to 2nd state out of area of where my son is. He has had his driver's license suspended a few times but never served jail time. I recieved his tax refund once when son was young but not since.
Definitely go to file in court to get some actions taken!! Circuit court-Family division I think-u could probably get some unemployment benefit if he collects that or gov't assitance.

You won't need to do anything about that, the state will automatically take the back support out of his taxes and send it directly to you for the amount and he can't do anything about it. And as for not paying in almost 6 months or more, than depending on the state there should be rules taking away privelages such as losing drivers license and possible jail time. I'd check into that maybe from either a judge or attorney....and best of luck! And hang in there the kids will def get there money!

I had to go through DHR (Department of Human Resources) when it came to getting my ex husband to pay taxes. I was able to figure the amount he was behind on my own. We had it stated in our divorce papers what the amount of child support owed was every month and I took my papers with me to DHR. I had bought a reciept book when he was first paying that way he had proof and so did I as to when the last payment was. It wasn't hard for the court system to figure the interest that the state added on to it from there. My ex was behind 2 yrs., so it looked real bad on him. For you though, 6 months will bad for him too. I definitely recommend maybe calling DHR and see if there is anything they can for you. I'm not sure what state you live in and how their laws are. I know for me DHR got this thing processed a lot faster than what I was able to do on my own. If you know the amount that he owes every month, go ahead and calculate that, so that you can give the amount to anyone who can help. The state wil figure they interest or taxes for you. As far as the tax checks go, I get a certain percentage of my ex's check. The state figured the amount and they have it in the system how much I receive, so when he files his taxes then it shows up the in their system, and they cut me a certain percent of it.
