Getting ready to go to court for custody. Dad wants 50/50, I dont agree. Our baby is only 3 1/2 months. He waas born 1 month early. What do you think chances are? This is his first child and he has no support here to help him.

Give him the chance to be the father he wants to be, but make sure it's not all fun and games to him. Does he have a plan for the baby's feeding schedule, was he able to get up at night for feeding while you two were together? If he wasn't much help then, either he'll step up or he'll realize he's just not capable to do it. If he doesn't help 50/50 between filing and this hearing they'll more than likely keep it the way you are currently caring for the child. The welfare of the child should be most important, period.

Are you breastfeeding? If you are then I would say he won't get 50/50 until he is weaned. It would also depend if he has c a good child care lined up and on the hours he works.

I didn't start 50/50 shared care until my youngest (to my 1st marriage) was 18 months.
