There is so much wrong with this I don't even know where to start.



1. It is illegal to have an abortion unless the woman/child can prove she was raped? some women can't even prove this after a lengthy trial let alone in time to terminate an unwanted pregnancy after some asshole has violated her.



2. The legal age of concent is 12?! Wtf! Yes yes different culture blah blah, but 12? I suppose I should be grateful there is a consenting age at all.



3. She's 10. That poor child :(

I'll tell you the difference,they are different gradings,therefore statutory rape,and rape are different gradings......

Mexico on the whole needs a good clean up Hope. In regards to this and all the other women and children who go through this every day it is just so very sad and heartbreaking for them. They should be entitled to the rights and freedoms that we enjoy everyday.

Just one last comment on the *statutory rape* vs *rape* thing. Different jurisdictions actually call it different things. Following are some of the terms which are used to explain or describe statutory rape:

Rape of a child
Sexual assault
Corruption of a minor
Carnal knowledge of a minor

So basically, it is RAPE. RAPE of a child.

The ONLY difference between the two is that force is *generally* not involved in statutory rape, but other coercive methods will be. What is your definition of *forced*. Physical force? Sometimes that is also used in statutory rape. Drugs? Ditto. Coercion? Ditto.

So the only REAL definitive difference? Age of the victim.

The more and more research I do, the more and more I feel for both the victim and her family. Even if they wanted to charge the father of this baby with rape, they had little or no chance of a conviction. Even though there is a law in place allow rape victims to have an abortion the chance you have that the authorities and the health care works are going to take you serious and do something about it is little to none. As far as I can see the family had 3 options 1. Go to the authorities, face mockery and get no solution 2. Go and get a back yard abortion and have a high risk of there daughter dying because they would be able to go get professional medical help without getting a jail sentence or 3. Allow there daughter to came the baby and have access to medical. If you were that girl or that girls parents what path would you choose. Remembering you are not in the USA, Australia or any other country were women are treated as equals.

That boy is 13, which would make him over the age of consent in Mexico.

I think if we are going to debate this topic we need to start understanding the culture of the country that this happened in. This debate goes much deeper then a 10 year old girl having a baby. Ladies read some of the links I have put up and start to understand the culture.

Because there isn't. It is all rape. Period. Non-consensual sex is rape. A child of 10 can't give consent for sex because they do not understand enough to be able to consent.

Lets get technical then Sharlene.

The term statutory rape generally refers to sex between an adult and a sexually mature minor past the age of puberty. Sexual relations with a prepubescent child, generically called "child molestation," is typically treated as a more serious crime. This girl was 10 and I doubt she was past puberty yet.

That's Ok Sharlene, I get the feeling that a lot of things don't make sense to you.

The point I was making - just because YOU can not imagine a scenario (like a drugged women consenting to sex because she is so high she thinks she is with her boyfriend), doesn't mean that it does not happen.

Just because you CAN see the possibility of a 10 year old having consenting sex with another 10 year old, doesn't mean that it happened in this situation and it does not change the legal definition of rape.

There may be a difference in sentencing, but not with the issue of consent. In either situation, the victim is identified as either being unwilling or unable to give consent. Which has been explained 7416 times already.

Sharlene, statutory rape IS rape, because legally the victim cannot consent because they lack the knowledge or understanding to do so. It is rape. It is also rape, as others have said, if a woman has *consensual* sex while under the influence of a date rape drug. It is actually non-consensual, because the person giving the *consent* is incapable of giving consent. Thus rape.



Statutory rape = rape.

It doesn't matter whether the girl said she was raped. The fact is, as has been explained several times, she was not the age of consent, and therefore, it is MOST PROBABLY statutory rape. It is highly improbably that the father is a boy the same age because boys that age GENERALLY are not producing active sperm.
