your first step is to get a lawyer. if you can't afford one, call legal aid. this is the link for legal aid in NC.

I got this next info off the web regarding law in NC:
"What is the Court Procedure in Custody/Visitation Cases?
One of the parties begins the process by filing a Complaint (lawsuit) for custody or visitation. The parties generally must attend mandatory court mediation before a
trial will be scheduled. In some jurisdictions, the parties must also attend parent education classes. In extreme cases, the court may appoint a Guardian ad Litem to represent the children or a mental health professional to perform a psychological
evaluation of the parties and/or the children. At a trial, the court will hear evidence and will decide what custody and visitation arrangement is in the best interests of the children."

you may not have been married, but in canada it's a similar procedure if all you're doing is fighting for custody.
i feel your pain, girl. i'm about to enter this nasty battle myself. i tried to resolve it, but he wants to fight...so we fight. get yourself a good lawyer, and a free one if possible, cuz this can cost tens of thousands of dollars. legal aid charged me 400$...trust me, it's worth it.
