Unless the father is a part of that child's life... you automatically have sole custody.
Also, mke sure his name is not on the birth certificate -

Goto the court house and ask for custody papers, they will give you every thing you need and send you in the right direction. Good luck!

I'm not sure, maybe it would be a good idea to speak to a lawyer, we have legal aid here and they give you advice for free.

I once tried to get sole custody of my son and the father had to sign papers, we ended up giving up it was a long process doing on it your own thats why I suggest getting legal advice and help.
