loss of a child I need advice

Okay this is going to ba long but I really need the help of other moms out there thats been through the loss of such an amazing gift and child. So here goes I lost my baby girl 3 years ago in September, she passed away exactly1 week after her first birthday. See she had a heart condition she had a leaky heart valve which menat it wasn't pumping blood through her heart like it should instead it was leaking. She was on medicine for it daily and also had a heart murmer she seen a cardioligist once a month also whom did ekg's and other test to make sure she was ok and in all other areas she was healthy as a horse very happy very loving could make you laugh and smile just looking in her eyes. Her cardioligst said she was healthy as can be. We she had gotten staph the week after her birthday we took her to the Dr. who sent us straight to the hospital and she was admitted keep in mind that she was still playing laughing and happy even throough the pain of staph. They ran test said it was MRSA staph and had to do immediant surgery to remove it before it got into her blood stream. Okay we arrived at the hospital around 11 A.M the Dr.s did test and all they needed to and said had to emergancy surgery to remover the staph, my husband and I told them she could not have any anastesia due to the heart condition as that is what we were told by her cardiologist because her heart could not handle the stress of being put to sleep at exactly 11 P.M twleve hours after all this they finallly come in and say they are gonna do surgery and they are puuting her to sleep, my husband and I again told them no she had a heart condition ( also keep in mind they never once called her cardiologist either for any updates on her) they took her out of our arms and went to surgery saying they checked her records and she was fine (which was not true they did not check her records) they called us back 26 mins after and told us she was fine we could go see her in a few mins I will never forget that moment when I heard code blue come across the intercome my daughter woke up screamed for about 2 mins and she went back to sleep and never woke up again they would not let us back there to see what was going on they waited 36 mins into resitating her to call her cardiologist to find out what went wrong and what to do. My daughter passed away at 12:26 A.M on 9/26/2009 I did get me a lawyer but my state has some kind of thing on medical malpractice and my lawyer sent it to several different big time people out of state and ended up no Dr. would testify against another dr.'s code or something so the case was dropped. I need to find some kind of justice for my daughter The thing is I know they Dr. who performed the surgery knew he was in the wrong because he called me on my personal phone for 3 months after everyday to make sure I was ok and I never met him a day before that day we went into the hospital.. as i told my lawyer before the case was dropped it is not the hospital's money i am after I just want to look that dr in the eye and let him see what I am feeling my daughter could be here with me today if he did not order her to be put to sleep for a simple surgery that could have been just numbed the area and lanced. I want the dr to know what was taking from me can anyone help me on finding out what I can do or if I can still get this in court by finding the right lawyer I need advice!!! ( also after the autopsy they found another rare heart condition that was undected by the ekgs but would not have been detected until she was older and active....they are saying this is the cause of her death but her cardiologist says that her herat just simply could not handle the stress of the anastesia)
