Estella Chandler and Michael Jensen have filed a wrongful death lawsuit against the Utah Division of Child and Family Services over the death of their 7-month-old daughter who died of asphyxia while in foster care.
According to court filings, baby Lailla was put down for a nap by her foster mother Suzanne ReKow, who then went outside to work in her yard. The police report says that when Suzanne returned after 30 to 40 minutes, baby Lailla was wedged between the mattress and the railing of the daybed. She was rushed to the hospital and died the next day.
The Utah State Medical Examiner’s Office wrote that the death was caused by accidental asphyxia due to wedging, and no criminal charges have been filed. However, Lailla’s parents said they want to send a message that the Utah DCFS must be held accountable. An attorney for the parents said that the government failed to protect the child, and that the “state is liable for its action in the loss of a precious life.”
The lawsuit seeks $300,000 in damages.
