I'm currently waiting for a jury to get custody of my son, my babys father has taken him and will not let me see him and the police will not do anything about it because neither of us have custody. I went online and saw pictures on his girlfriends facebook page, one of the pictures is of her kissing my son on the lips(he's 2.5 by the way). I find that very disturbing to myself, could I use that picture in court?

Why is a mother automatically entitled to sole custody of a child? Why is the default not 50/50? Two parents, two are equally responsible. She shouldn't "get him back." She should get 50% custody.

Of course it can be upsetting seeing another woman getting to be close to your son when you can't. But if she's not a drug-addict or an abuser, and she may be around a while, it would benefit all of you to foster a good relationship among all the adults in this child's life.

Its not a big deal and a judge wont give you browning points over it in court. im sure it bothers you on a personal level, that there is a step mother type in his life more then the Kiss in general

HI Malina! Well, I personally would not want anyone other than myself kissing my kids on the mouth. I don't think there's any "wrongness" to it as long as it's kept appropriate (thats a whole other topic). I'm more concerned with someone passing on something like cold sores or illnesses to my child than being disturbed about it....ok....sorta..lol...yea, I think I would be mildly disturbed too.... that's my baby! Keep your lips off my kid...but, this is only my opinion. Good luck with the custody case! Take care, Christina

I agree with Sherri and I hope you get your baby back soon.

I am just referring to the kiss. Not the situation, you asked if there is something wrong with someone kissing your child no there isn't. By law only she hasn't in the least done something wrong. The situation itself stinks and for that I am very sorry.

when your babys father wont give you your child back and you see his girlfriend kissing your son on the lips, you'll find it as a big deal.

I would say it depends on the kiss. If it's just a sweet little smooch, then no harm done. If it looks at all sexual, then ask your lawyer if you think it would be admissible.

No I kiss kids on the lips all the time. Mine as well as my friends, my daycare kids etc. Maybe she really loves your little boy I don't see what the big deal is.
