BM has been deleting my texts and or not giving the messages to ss12. I am livid. DH says there's nothing we can do about it and to stop texting

I would definately have a talk with DH and let him know you are his partner and not BM for one, and then I would let him know he needs to tell his son to keep his cell phone and text messages private. If a 12 year old is allowing his mom to see text messages, he must be under her thumb too much. Who pays the cell phone bill? Don't back down.
