can i change the last name of my son if he has my last name now?

My sons biological father hasn't been in fhe picture at all and did not sign the birth certificate, however paternity was established. if my son has my last name can i legally change it to the one he knows as his daddy.

His father is not around and I will not allow him to have his last name but when i get married can my husband adopt my son without the fathers consent considering he didn't sign the bc and is not involved

It can get costly to do so. It will require filings that take a lawyer, don't fall for the websites that promise quick and easy filings. Also, from what I have read all cases were where the child regained the mother's last name. To change it to his father's last name without the father's signature on the birth certificate regardless of paternity, will be another legal filling. All of this will of course require the father to appear and take part in the name change with signatures on the filings.

The fact that you and your son share the same last name will be much easier to deal with when it comes to school and and legal signature for him. Give that some thought.
