Child Support Complications?

My son is 2 years old now and I do not get child support. I have filed before and they were unable to locate his father. Now, I am trying again, but his father has not filed taxes for many years and works from home selling ripped off software on the internet. Obviously, he is doing this illegaly and not paying taxes, so when we go to court what exactly will be used to prove his income? Somehow, he manages to live in a high rise luxury condo, drive a cadillac, go out to eat every night, etc....He brags that he make thousand's of dollars a month, but somehow can't come up w/a few bucks to send for his son. I guess I am wondering how the courts are going to see his situation and what they will be able to make him pay? I will do anything I can to prove his income, as it is not fair that he gets to do whatever he wants whenever he wants. I really feel like I need to fight for my son's rights here nomatter what the cost.

hes obligated to pay and the courts take it very seriously, they will court order statements from him and if he doesnt provide it thats a breech of a court order. All my ex did was tell me he was working and duty council is doing the rest i didnt have to know where how much he was making anything. just get all the documentation u can and they will handle investigating it, most likely not only is he going to have to pay support he's going to get nailed for the taxes and illegal activity. when it comes to child support in court the best thing u can do other than getting every scrap of documentation as you can is keep ur position neutral. he has a financial responsability and thats all that concerns u, any bit of "personal" and it will work against u. and never fear because say they cant prove he has money it'll be put on hold till he gets a job which he will have no choice unless he can prove a reason why he cant work, and he will owe. if it gets past a certain amount they put the deadbeats in jail until the money is paid by family members or whoever. i wish you the best of luck and i feel ur frustration - currently dealing with child support bs myself. but try not to worry too much about it.

You can submit evidence of his lifestyle as proof that he is earning significant income.... subpoena his checking, savings, and any other banking records to show what he brings in OR what he is spending... credit card receipts, debit card records.

If he's told anyone how much he makes, have them testify.

You will need to find documentation to show that he pays for the condo, bought the cadillac, etc.... but lifestyle is definitely relevant to show means.
