How about my rights when it comes to my money

I totally understand, we live in a 1 bedroom apartment & I am just getting back to full time now that my little one is a little over 2 now & I have been working part time. My Husbands child sup went ip insanely because of all his OT this past year. Well no more, bottom line is, they should pay for the care of the child, we all know, that half the money asked for is NOT needed, so they milk it. They spend it on themselves & their boyfriends etc & still complain to us & kids they are so broke etc. Yet they basically get "paid" to take care of their own child. We don't we have to take care of our own & someone elses children, issues & all. Like they have said above, the BM's are happy to collect our hard work, my Husbands Ex just moved to Princeton into a 2 bedroom apartment with her BF & the child & my Husband is paying $900 a month, basically paying rent for the entire apartment & we can't afford a 2 bed room ourselves and need it desperately, we have a rent of $1,000 & our own bills & NJ is not cheap! yet BM doesn't work and never had to put her child in daycare, and I have no other choice to pay for fill child care, basically 60% of my pay goes out the door, I can't expect any more money from Husband because he's broke enough. So, yes, one thing I do tke to heart, this is not going to be forever, it's a 10-15 yr stretch for most of us, yes, we'd rather utilize the funds our own way, but have to accept reality for what it is. Let them deal with not building a career or their own & becoming totally dependent on child support only to one day not have it anymore & now have to scramble & figure out how to pay their own way some day! It's not as long as the entire marriage it can only go on so long, so We are the one that gets to keep the Man, they ALL want back & too bad...once the pay check for them runs out, they will have NO more to deal with the Ex & have to find a new way of annoying someone else!

A lot of states do that. They take the spouses money for back child support. Here's a tip file married but seperately next year so that they don't touch yours, only your hubbys.

Check with your state laws... here, in TN there is a spousal protection form that can be filled out so the spouse can get all their refund... Also, same boat with my hubby and we have to file married but seperate so that she can't take any of my money. Its up to the state laws. You have rights! You just have to know what they are.

I feel your pain too. Im in AU and we dont lodge our taxes together here, but the amount of C.S we had to pay for 1 child was more than they left us with 4 children, who didnt work part time. 3/4 of his pay had to go to her and the daughter was ringing us and asking us for money as her mum would give her any...grrrr

Unfortunately, this happens all the time. As stupid as this sounds, until CS is caught up, you'll need to file seperately. That's the only way you will be able to keep "your" money. I'm on your side though.

ah...god ole C.S. My Hubby is paying $900 a month to his ex who refuses to get a job & lives in a 2 bedroom apartment near Princeton NJ, super nice area, He "paid" for a car as a loan for her & she got out of paying him 9k back, judge ordered only 2400 back (my money too) and We live in a 1 bedroom apartment in a not so nice area with a 2yr old still in a crib, I have to work & pay a sitter 60% of my money & she sits on her literally 300 pound fat ass & does NADDA! We sold a home, they USED to live in (I moved in after the split etc) and that's how he paid for the car, I paid into the place for 2 years & a good 20K was supposed to be mine...I have not gotten a D-I-M-E Believe me..I know...

in time, we can look back on this & one day, when kid turns 18, we can let 'em HAVE IT!!! Just take heart...that day WILL come! And you will HAVE your chance to FINALLY tell her off!!!!

i feel your anger...its just not fair..i had to file injure spouse..n that can take up to 3months to to my money..if the irs think i should get any at all..

Sounds all too familiar. Except in our case it was child support enforcement who screwed up paperwork and ended up taking part of our tax refund. Apparently you're only required to have two brain cells more than a freaking cabbage to work for child support enforcement...

my husband owes back cs as well from not being able to work when he was in the hospital ive looked into what i need to do so my taxes dont go to these women and you have to file injured spouse so they cannot take yours only his so next year if you file together again make sure you file him as injured so that they cant take your money only his im doing the same this year as well

I agree! We had a judgement that if my hubby could get his back child support all paid off by the end of this year, he could claim his daughter. Well he had money taken out of every check but it wasn't enough, so his ex gets our whole return (which is only big because we had a child this year) and she gets to claim her daughter for earned income credit. That's bull, she "worked" for her own lawyer, while she was living with her!!!!

I'm just mad because the money we would have gotten from having our own son, and the improvements we could have made to our life ( like getting a 4 door vehicle) are paying for the other child

Oh yes I hear you- I wont go into my story b/c you dont have 8 weeks to sit and read it but I definitely hear you. We have NO rights but some BM's are quite happy for us to be financially responsible for the kids.
