HUGE Child Support question, PLEASE HELP?

Recently my husband went to court, and his child support was doubled. We were barely making it by as it was, but now I don't know how we're going to make it. Here's the thing... I noticed in the court child support worksheet it says "Child care wages-$0" Well guess what, we pay $110 a week for our son's daycare. Right now my husband's child support is $96 a week.... online with the child care added in (I did an online worksheet) it says my husband should be paying $27 a week. WHAT?!? So before this gets too deep, is this true? Should what we pay in child care expenses matter in how much child support he pays? AND how can we get back to court to fix it if it is true? Can we do an emergency hearing, because we need this money to feed our son and diaper him. BM lives with parents and eats from food stamps, she doesn't need the money like we do, she pays no bills, we pay all our bills. PLEASE HELP! I need everyone's input, because if we can do something about this, we need to act fast!!!!

As someone else says.. child support ranges from state to state. Go talk to someone in your state or where your support is and get it figured out. If hubby is paying medical care for the kids that should be accounted for as well.

Child support is a huge issue - If you are paying daycare for a child that you share with him, then no, it is not included when calculating expenses for his child. But it should be reflected in your household expenses. In Texas, the non custodial parent (your husband) also pays for medical insurance as well as support. Child support regulations vary from state to state. You can always call the child support office and request a review of the support order, and request to go back before the judge if you feel that your income and expenses were not conveyed properly when the current support order was increased. Good luck - it took us almost a year to get my husband's ex before a judge to re-evaluate her support order.

the child support sheet is only for the child he is paying support for, not for your child. if he pays child care for that child then yes they should of had it in there but if its for a child you and him share together than no its not added in.

go to your local court house, and see if they have a self-help area. if not, look up the state code statutes for child support. it's gonna be a lot of jargon, but if you don't have a self help area or a court law library that can give you answers then the state codes can help. either way, you can always go back to court and ask for a new evaluation based on time spent with the child and expenses made in the household vs. the income of the household. good luck!

i have two suggestions, first apply for food stamps it helps a lot even if you only get a little it will help and they do take all of your bills into account including child support, daycare, and rent. my other suggestion is that you talk to your lawyer about getting the child support lowered (adding in daycare to your expenses) though i know that in the state of iowa they base it primarily on yearly income, so talk to your lawyer and see what they say.
