need advice on SD adoption,,,

long story story my DH has full custody of my SD, I have been her "mommy" since she was 2 ( she is now 8). her BM has has less then nothing to do with her for the last 3 years..no birthday cards, Christmas gifts, visits and she has called no more then a dozen times over the last 3 years..however she decided that she wanted to see my SD over the summer break..she was due to return her on a certain date and failed to show up. My DH had to drive 16.5 hours to find our girl..since then ( over a month ago) she hasnt called or made any contact..my SD has told us awful things such as her BM being held in jail over night and leaving her with her 12 y/o sister for days on end..i could go on and on..anyways i want to adopt my SD as she begs for me not to let her go again...ive never adopted anyone and im worried that if i serve BM and we dont win the case she will make life living hell ( more so then it is now..) any other SM's go threw adoption? any advice to strengthen my case?? thanks in advance :)

thanks ladies yes i have a paper trail from canada all the way down to you fine ladies :) we are getting all our ducks in a row now so i will try and keep you all posted..good luck and remember to keep being the best mommas you can be ♥

You will have to look at the guidelines in your state. I live in MO and my ss bm has not had contact with him in 3 years (and he is 3 years old). Here the abandonment is 6 months of no contact of any kind. We are actually currently waiting on our lawyer to file the paperwork through the courts so we can get bm served and hopefully get this adoption going...although in any case if she will not voluntarily sign away rights (we called ours and even though its been that long with no contact of any kind, she will not agree, but also has no interest in seeing him now) there is still a possibility that the judge will not find in our favor and not let the adoption go through.
The only other thing I can say is just make sure you document everything, and with your sd being older and knowing bm that might help your case if she doesn't want to see her any more, although I'm not sure.

thanks amanda i had NO idea that the abandonment time line was sooo short!! thats amazing info thank you! Good luck to you all i wish you all the best and ill keep my fingers crossed for all of you :)
