I also want to add in preschool there was a little girl who would not leave my sons side, the teachers noticed it and pulled my son aside and asked him if it bothered him. He said it didn't but they told him if it did to let them know, I was pulled aside at pick up and informed of the situation, the teachers also used redirection on the little girl. My point is this wasn't even negative behavior like you're describing and it was still addressed.

There's 39 kids in your sons preschool class? I'd find a smaller preschool class my son had 10 and there was an assistant. I would definitely talk to the teacher and put her on notice, I realize she has many kids to watch and teach but if another child is leaving bruises someone needs to be taking notice.

I would let the teacher know whats going on and tell your son that he needs to tell the teacher whenever this other child hits or kicks him. this might help bring it to the teachers attention so she can give some consequences to the child at the time he is inflicting the bruises and holefully that would curb the problem. Other than that if he loves preschool it is prob nothing to get too seriously worried about. Kids will be kids and the other child might not have been shown acceptable ways to vent emotions.
