i have a 10 months old baby, me and my husband, for cause of his family coming into our relationship and telling him to leave me, are getting a divorce.. now im very scared because the baby will learn nothing good from them, i read a text from my husband that said that he was going to kill my brother to death and when i asked him why would he say that he wanted to back up, he has beaten me in the past unfortunately i thought everything was going to get better so i dont have any prove.. he is always out the house with his family and in two occasion when the baby was sick he left me alone because his family called him to go out.. im really nervous about all this and dont know what to do, the other day him and his brother was following me for no reason as i walked thru the apartments.. his family sent him texts to leave me and if anything to call them so he wont go to jail for beaten on me.. is there any way that he sees the child only with me or nothing at all?

You have to get a lawyer and go to court to get custody of your child and set up visitation for the father. If you can get away from him and go to a women's shelter or somewhere safe, then do that. If there's any violence or threat of violence, call the police and file a report. If you can communicate by texting or e-mail, then do that so you have proof of his threats and/or violent behavior. The judge will not act on just your word that he is violent without proof. If you can prove violence, the judge may award supervised visits with the child for a period of time. I can't guarantee that you'll get sole custody, but getting a lawyer is your best chance.
