absent father

My daughter's father come and goes. We separated almost four years ago and ever since then she has seen him a about a months worth of days (and I'm being generous). This last stint he didn't even attempt to call for almosta year. Then he pops up with his attitude of he's owed time. Everyone must drop what their doing to put up with a total irrational childish prick. I get no money no help no NOTHING. I went to try and get custody of her but they said I have nothing if I can't serve him the papers. The reason I went to start a custody case is because he has threatened to take her and I have no idea where he lives. I worry. Any advise for my pain in the butt? Besides him magically disappearing (fingers crossed)

He does have rights then to the relationship with his child just as you are. And depending on where you live they can legally set a notice in newspapers that is a legal one and it would give him a chance to show up or make himself known to the court. My sister had to do this when she filed for divorce from her husband (1st husband) when she was much younger. It was ran for 30 days in the newpapers and when he did not show up, she got the divorce in her favor. So, for the custody thing to work the same way, your state has to have it in the law books, and it has to run a certain length of time, and then if he does not show for court or make himself known to anyone that is listed in paper to call, you get custody set. I have heard of this before. But you can not ignore him because one day he might just show up and file for custody and you would be served papers to show in court for custody and visits. Go the legal route.

Can I just ignore him? If it wasn't for me having the same number for ten years he wouldn't even know how to contact us. By the way there is allot more to mention but let's just say he is a total deadbeat.one more thing he is on the birth certificate.
