I have a 10 month old and me and his father is not together I am considering to give him a chance to see his son Sunday night until Tuesday @ 1:30PM when I get off work, but I'm concerned that he will not bring him back at that time. I want to know what can I do at that time if he done show up with my child, should I also have him sign an agreement saying that he will return him at that time? There is not a court order in place as yet but I'm trying to give him a chance to help himself

ok thanks and I also didn't mention that his name is not on anything for my son, but I do understand what you ladies are saying and he will not be going with him until the court can set up something for him.

Evelyn is right. While he is the father and has a right to spend time w/ his child... there is NO WAY I'd be letting him take that baby out of my sight w/out a court order. If he decides to keep the child... there is nothing you can do about it other than go to court and fight to get your baby back. If you have a court order spelling out when you have the child and when he has the child... then if either of you violates it there are legal repercussions.

You need a COURT ORDERED custody, visitation and child support. At this point no written agreement is going to guarentee that your child is returned to you. Since no court orders are in place you both have equal rights to the child. Get a lawyer. I do not understand people these days who have kids and then think that if they set up visits on their own that the other parent will agree to return the child to them. Those verbal and written agreements outside the court do not mean anything. The value of those agreements is about the same value as that paper its on and the police will not intervene if there is no court orders.
