you will get custody unless they can prove you are an unfit mother. seeing as though, he hasnt been around in months, there should be no problem. go for it. but make sure you have a lawyer.

Then, Martina, you do need to get an attorney, and get him to draw up papers for sole legal custody (you have all the legal, and medical decisions for them) as well as physical custody with visitation.

While you're doing that have them draw up papers for standard child support as well. Don't be afraid to go into a courtroom. If you have your representation, you'll be fine.

Best of luck

Well, no-one can tell you how it will turn out. However, you need to keep in mind that if he decides to fight it when you file, he probably will get awarded some form of visitation. But even if he doesn't fight it now, just remember to always keep the door open. One day he may want to step up and be a father to his kids, and they should have the opportunity to get to know him.

I am not sure what you mean by maintenance. Child support? Yes, you should absolutely be entitled to this. Where I live, maintenance refers to spousal support, which I don't necessarily agree with, but depends on the circumstances.

i would go for child support and a standard visitation schedule... that way if he choses to see the kids that he is allowed to. as angry as you are at him, it would be best for the kids if they had an involved father.
