Anyone have advice on child support ?

I threw my husband out when my son was 10 months old. My son & I haven't seen or heard from him since, my son is 17 now I lost my job & my unemployment has ran out, I've always worked & supported my son on my own. I was told years ago when I went for info on a divorce that I would never get child support if my husband didn't work (when he did work it was usually for cash) I can't afford an attorney but can file myself for divorce is it worth trying to go after him for support or just give up on that?

I don't know what state you're in, but here in NY, child support is not retroactive. Which means, your support starts the day you file- regardless if the kid is turning 21 in two days.

I would consult a probono lawyer and file the paperwork anyway. Even if he isn't employed, the government tends to be cut-throat about child support so they can garnish savings, social security, incomes taxes- ANYTHING AND EVERYTHING.

I hope you didn't let your ego get in the way of the financial support your son deserved/s.

Also, you say you haven't seen/heard from him since. Just know you will need to know at least his last known location for the enforcement unit to collect the support on your behalf.

Well, you should have done it 17 years ago. Not sure how easily it can be filed for now, and an attorney is definitely necessary.

Are you ready to have your son meet his biological father? Because that could be a requirement. You can claim non support/abandonment, but he can claim that you withheld his child from him purposely.

It seems kind of crazy to wait all this time, then try to get child support. Legally I think he is obligated to pay anyway, but I think you're going to have a hard time getting it to go through at this point.
