Attorney or no attorney?

My ex was arrested for an assult 4 felony (because our minor child was in the room) a few months ago. He has pled not guilty and it may go to trial if he doesn't take the plea bargain next month. On top of that I was surved custody papers the day he got arrested. We're going through separate mediations now. I had my first one today. I was told he has an attorney now for the custody case. I was also told that the courts only focus on the present and furture, not the past. There was a 3 mo period I stayed at a friends and saw my son almost daily, took him over night a few times. I heard he's gather info to prove that I "abandoned" my son. Now I have had him since March 26th and he's had him 3 nights (on seperate occasions) since we were granted 3rd party contact so we can share our son. Should I get an attorney?

I think you should get an attorney if you can, so you would be on more even footing with your ex. Do you have e-mail or text communications during the time you stayed with your friend to show you stayed in contact with your son? If so, show those as evidence that you did not abandon him.

Yes, get an attorney. They know the ins and outs of they system, and are better equipped to offer sound evidence in answer to the father's claims. If he has one and you do not, you are almost inevitably bound to lose the battle and the war.

If he has an attorney, you should definitely have one. I'm not saying this is a case you will lose if not, but just to be on the safe side I would. That attorney will get up and make you sound like the most horrible person in the world. I know this bc I've been through it with my kids and am about to go through it again with my husband and step daughters.
