My boyfriend/baby daddy is in jail right now and he will not be out until two weeks after our son is born. We're happily still together and all and excited about our baby. But Could I still put his name on the birth certificate and give my baby his last name if he isn't present? I live in California btw.

That you might be able to do. I am not sure if California has any certain laws on that, but here you can put any name for the child's last name.....it does not even have to be yours or his last name.

No, if he is not present at the birth you can't put his name on the birth certificate. He will need to sign a document that states that he is the father and some states require a DNA test done....others do not....just the signed document.
