Can my daughters father take custody because I am going through a divorce with my husband?

My oldest daughter is 6 and I was never married to her father. I have custody and we get along great. In fact we are close friends. I let him know I will be filling for divorce very soon. His reply was he doesn't want her to go through that and that final and I need to give him custody. WHAT?!? I told him no way especially since he just moved across state (and according to the custody arrangement I wasn't allowed to move out of county because it would take her to far away). I told him he would have to take me to court and that would put her through more. Can ge get custody because I am going through a divorce?

If you provide a stable and loving home, most likely not, but I would talk to a lawyer. Also, make sure that you are abiding by the custody agreement to the letter and fostering a relationship between them.

Above all, talk to a lawyer. :)
