Can my step-daughter's mother take her phone away from her that we pay for and that is how we keep in contact with her

My husband has joint custody of his daughter and she spend half of the week with us and the other half with her mother. We got her a cell phone so that we could keep in contact with her while she is with her mother. We pay for the service. Recently my step-daughter informed us that her mother and step-dad take her phone from her when she gets to their house and told her she didn't get permission to bring it into their house. Can they legally do that when they don't pay for it?? What can we do to prevent her mother and step-dad from doing this again??

They don't have to let her have the cell phone IF they have another way for her father to keep in contact with her. If they aren't allowing him to contact her at all... then he needs to be going to court for this.

Your house, your rules. Their house, their rules. If they don't want her to use a cell phone while there then that is their business. If they aren't allowing her father to contact her... that is his business.

I would say yes they are allowed to do this. However - I don't think it's right they don't let you have contact with her when she is with them. How old is she? Maybe consider bringing this fact to court to have it addressed. However, I would think since it's 50/50 custody - your house your rules.. their house their rules.
