If she does not respond or show in court that is on her and will look bad on her part. A court can order a paternity test to prove his being the father or not. It is in your BF's best interest to continue with this to prove the child is his and then to take the steps to have custody, visitation and child support worked out.

If he petitions the court for something (assuming paternity is determined) and she doesn't respond, contest it, or show up in court... he is likely to get whatever he asks for. No one can accurately predict what will happen in his court case though. There shouldn't be any reason he won't immediately get some sort of visitation. She can refuse to cooperate, of course, but then it's up to him to keep documenting and take her back to court.

She would have to prove that he would be a danger to the child and that would be hard to do. Until those court orders are in place he has to keep trying to see the child, document those times, and present them in court if he does not get any time at all. Se can loose custody for withholding the child from him but first he needs to know that the baby is his.

Going to court is the only way to settle things. He needs to get a lawyer and petition the court for a paternity test (unless one was already done) and file for joint custody.
