Lisa, I'll add this: for my son, we had to publish a legal notice in the local newspaper for 6 weeks. If any one had a reason against it, that gave them the opportunity to respond. In ours, there was no response (mainly because it was a spelling mistake when the bc was originally entered), so the judge ruled for the change, and ordered the bc be amended.
I would imagine that, if there were any protest, the judge would then call everyone to appear and present reasons prior to making the decision.
However...LOL...if you're not in the US (good chance of that, since this is an international forum), I'd seek an attorney or solicitor's advice.

I have been living the same place he just stayed away just being stubborn she saw him this may for the first time in 8 years and she said she didn't remember him and he's not her father, she don't want to see him again, he abandoned her and the only father she knows is him pointing to my husband

Depending on why she hasn't seen him (have you moved away and not allowed it or has he never tried), you may be able to get it ruled that he abandoned her. But still, you are unlikely to be able to change name either without his permission, or without the permission of the courts.
