Can my husband claim my kids on his taxes even if he don't leave with them?we still married but we been separate for 6 years.

If you do not have any court orders about being separated then either of you can file for the kids. You need to court orders set up to make sure you are the one who files the kids on taxes.

I am Canadian. I am not sure if Sarah's comment is accurate. Unless you still live together. If you are both managing a separate household you may be able to file separately. You will need to notify the government that you are separated though.

Are you American or Canadian? I am certain the rules will be different based on that.

If you are separated, you should go to court for legal separation and/or divorce. They will decide who is the resident parent, and that person will claim the child(ren) on their taxes. If they live with you more than 50 % then you should claim them on your taxes, not him.

Im american i use to claim my kids before but some how he get them now.he pays child support but i think is unfair that my kids pay for their own child support with the taxes.
