So I was previously married and we had to stay married throughout my pregnancy legally because of the state rules here in Ohio. My ex and i had different last names but once the child was born i gave her my soon to be new last name and now my ex whom is not or has never been a resident of Ohio wants to change her last name to his but i refuse. Is he able to change it since he is not a resident of the county? Would the courts allow us to keep her current last name but ad her bio-dads last name as well?

Eaxh state has differing laws but usually once the name is established on the birth certificate you would have to go to court to petition a name change. Each parent would need to consent to the change so I dont see how it would be remotely possible for your ex to change your child's name without your consent. I would just say no, too bad so sad. If he bothers you again, tell him to talk to his lawyer.

You can have it hyphenated if that is what you want. That way she can have both of your last names.
