my ex and i have been to court for custody, we have joint legal custody...and i have sole physical. The orders were made back in July 2014, the judge stated to come back in Nov 2014 for a review...my ex was told not to drink around our daughter from June to July (temp orders). He failed to do this and i brought it up in court...I think that's why I got sole physical...well my ex is stating he has been over 50 days sober...my question or concern is would the judge change the sole physical for any reason? I mean, i'm not an alcoholic, i'm a very good mom, and she has always lived with me since birth and her dad has been the one to be in and out of the home...has anyone else gone back for a review and things not gone their way...

None of us can tell you this. None of the ones on here that I know of are lawyers. We can not give out legal advice at all. What we can do is tell you what might come of it. It is going to depend on the judge really and what he or she thinks needs to be done in the best interest of your child. If he or she feels you are the best choice for sole living arrangements and giving dad a say legally in everything concerning her care, schooling, and other upbringing. The judge could also decide to give him half time too. It just depends on your situation, the laws of your state, and so on. Your best bet is to see what your lawyer has to say.

he ordered him not to drink around her or let a third party drink around her, on our paper work it just states return on x date for a review...her father expressed to me since he is HER father he wants joint physical custody,not just legal. I dont mind him having more time but because she is only 2 1/2, i think she needs a stable home. He has been the one in and out of the home since she was born. he has recently purchased a home and is fighting me for child support, he thinks child support is ordering him to pay too much. I was just curious if the judge would give him joint physical since he has awarded me sole...

Its really up to the judge and what is decided to do. If this man is only 50 days sober and has proof he is going to AA or another counseling situation, he might get a bit more visitation. Like I said its on the judge to decide. 50 days is not a great length of time to prove that you are good enough to change up the custody. It might take a lot more than that. What did the judge actually order him to do besides not drink around your daughter?
