Can my son father get his name (any part first middle or last) changed with me knowing about it?

If you're in the US, no, it takes court involvement, petitions, and agreement by both parents

He can not do that if he is not a custodial parent or has joint custody. You would have to agree and then a judge would have to okay it after finding out the reasons why.

ok cause he talking about well whenever the court order comes through is given he going to go get his name changed.

That would be a long drawn out process including the both of you since labeled the topic court ordered visitation. If you have majority custody and decision making then no he can not just change the name without your consent. I would think that if the name is already on a birth certificate like it is, it would take a court order to change it.
