I've been divorced for almost 3 years. My ex husband gave me full custody of our 2 children and moved a thousand miles away to Illinois and has only seen the kids twice since we split. He's canceled other trips because he said he doesn't have the money since I make him pay child support. Now after 6 months of him never calling he calls with the excuse of telling my daughter happy birthday... Surprise.. He wants me to let him claim 1 of the kids on taxes. I told him no and now he says he's going to put me in jail for not letting him see his kids. Any advice?

Well h & r block said he couldn't claim them unless I gave permission especially since he never sees them and said child support is not tax deductible. I never said he couldn't see them but he is claiming I did. What makes me angry is he used my daughter as an excuse to ask me about the taxes then told her he was gonna put me in jail and get full custody. He always puts her in the middle when he does talk to her

He can't put you in jail for something you did not do. If he gave you full custody then that's what the court would consider. Has he ever come to see them and you turned him away? If no, don't sweat it. I would talk to your accountant or attorney. I don't know what rules apply to a parent that pays support claiming a child as a dependent.
