I've been raising my daughter alone since birth.she is almost 7 now.i never filed 100% legal & physical custody of her .father is absent.will the courts grant me custody without permission from deadbeat dad?

Depends. Can you contact him? His family? If you've tried, you have to list the hearing in the newspaper for a certain period of time before the hearing. He has to be notified of any court hearing and be provided all documents filed with The Court. He has to have an opportunity to be heard (seriously??!!!). I've just spent almost 2 years in court representing myself and fighting for child support. I got to the point where we can't go further without it. I've been working 2 jobs for over 7 years, working 70hrs/wk. I have a daughter in college and one a junior in HS. I'm needed at home. Good luck!

You will probably get custody (no guarantees, but if you have evidence that he hasn't been involved and he doesn't have evidence that you've prevented his involvement... it's likely), but if he shows up to the court date and wants visitation rights... it is likely that those will be granted (probably supervised at first)... as they should. If he doesn't show up and doesn't contest anything... you will likely be granted whatever you ask.

You would be wise to ask a lawyer about your situation though as laws vary greatly from country to country and even state to state.

I cannot contact him I don't even know where he is but he's even in this country I've never seen or talked to his family they don't even speak English they live in Turkey so chances are I have pretty good odds to have custody of her God willing

well I guess the only evidence I have is her testifying because she has never seen or met him and I have never gotten any child support he has been absent for almost 7 years and he is not even in the area hopefully he got transported back to his country lol he is not a legal citizen, wHi chief he lied to me ,he was here on a working permit

he lives out of State and is actually not even a US citizen he's here on a work permission and as far as I've heard he was out of the country for most of the year, last year. so I have not tried to contact him and he has not tried to contact me for almost 7 years so I would consider that an abandonment I live in Pennsylvania I'm just going to go to the courthouse and file what I can for now and see what happens. thank you all for your responses.you would think it would be pretty cut and dry but he can have the biggest piece of crap father and they will still give him right as a sperm donor

Get an attorney. They will help you take the necessary steps for notification of the child's father. At that point, yes, the child's father will have an opportunity to at least get visitation. You need to file for custody and get a support order on file with the courts as well.

Without permission, no. But if dad chooses not to show up to court, he is essentially giving his permission by demonstrating he has no interest. But like Dove said, if he shows up and expresses interest, he is likely to be given a chance at something. In some places, you could file abandonment. Talk to a lawyer where you live to get the correct information on the laws, as they are different depending on where you are.
