I am a single mom of a 4 year old girl her father is currently in jail for domestic violence against me he has been in jail for all but 6 months of her life for verious things.He gets out soon I don't know if I have legal full custody of her considering I've never filed do I need to

The courts tend to move slowly unless you are filing a temporary emergency order of protection. Will he be on parole when released? He likely will know his release date or do you mean will he be sent notice of your petition for sole custody? I don't know what information will be sent to him while he is in jail but he likely will be told, becasue he has a right to know. Find a Family Law attorney and get started.

You'll need to get yourself a lawyer. How long it takes depends on how busy the courts are.

Yeah I live in Colorado we have vine they will notify me he gets out in October do you know if they will notify him while he's in there..and how long the process will take

When he gets out, since you were the victim of a crime he committed, you should be notified of his release date. Take action before he gets out.

Yes, you do. Unless there is a restraining order in place that protects the both of you or it is part of his probation or parole agreement to not contact you or the child. He is her father and has just as much right to her as you do. Contact a lawyer and file a petition for full custody.
