Custody Battle

My eleven year old step daughter is an awesome kid, she had a very close relationship with her dad, but the day after Christmas my husband grounded her from her I-pod and now we are facing a big custody battle. she doesn't want to stay with us any more or even talk to her dad we had 50/50 time sharing, we have only seen her on her events where she is very rude with us and she stayed one night with us in the last 2 months.

She's 11. She doesn't get to call the shots. If dad is not sticking to the custody agreement, then he is breaking the law (if your custody agreement says 50/50).

If you don't have a custody order from the courts, then yes, you are going to need to get one and it's anyone's guess which way the judge will go. However, in many places, 50/50 is the norm and an 11 year old doesn't get to have a say.

It is up to your husband to deal with this in court. I can not tell you if the judge will decide one way or another on this as I do not know the mind set of the judge. So this is over her losing use of an iPod?
