custody help and guidance needed?

ok im a teen mom i got married at 16 and dropped out then became homless then i got pregnant and my husband was abusive when i was 4 months along i relised i had to make a choice for my child i had to leave my husband so my baby would be safe and have a home so i left and found a place to live with friends i met a new guy when i was 6 months along he cut her courd when she was born he had a job a car and his family took me and my baby in like i was one of them we had to move a few times after she was born and dcf was always on me because i was young and old friends turned enemy kept calling on me even though they lived in another city and never even met my baby girl but yes when she was 6 months old i couldent make ends meet so i desided to leave my bf and his family with temp custady to go to tampa (a bigger city) to fin a job witch i did but then my husbands half brother and wife wanted to have my baby for a weekend for there daughters forth bday and i met them and they seemed supper nice he was in the army and she was a stay at home mom so i let them then i moved after i signed papers only to my bf and his mom but my husbands family desided not to bring her back they even asked if they could keep her i dident know them very well so i said no of corce but they did anyways i went to the cops and called them kidnappers and asked for a ride there to get her over the internet no one helped and the cops had tould me they had gone and gotten my husband so they couldent do anything and no one helped so i freaked and cussed at them never thretend them others did on facebook though since then we have gone to cort and since my job did not work out and they had mor going for them i just agreed to give them not my husband temp custady im now 18 her 1st bdays in a few days im scared as to how ima get her back and she dosent even remember me when i go see her its so painful but i do have my ged now and i am going to colage i just i dont know how im going to fix this my husband has since went back to being homless since he dose not care for her my boyfriend and i still see her but we have only seen her 3 times since they took her please some advise would realy help sorry for all the mispelling i was in a rush

are they letting you see her when you want? you may just need to be in her life more. and take her back. if it is temporary than you just go to them and tell them you are ready for her to come home. tell them you are not a child any more and be grateful for the job they did with her. but she is your baby and you deserve the chance to be her mom. it should be that simple if you havent abandoned her by the law in your state. in my state i believe it is abandonment after 6 months with out contact. i hope this helps. keep reaching out and someone will help you.

i had a loyer to begin with but how can they say its abandonment if i gave temp custady to someone befor i left

they may say you abandoned your baby which can cause a different set of rules to re enter the babys life. you are doing the right thing asking for help. maybe call a lawyer to seek advice. i dont think they will charge you for advice over the phone but i may be wrong about that.

so you have or share legal custody? someone has to be the legal guardian of the baby

no like i said i gave them temp costady with an open time frame and open visatashion its my husd=bands half brother and his wife

so who has custody of the baby?
you are going to have to fight for custody.
that means get a lawyer and prove that you can support the baby. ..
but you can't get custody until you apply through the court for visitation and go to the visits for a year.
then you can sue for custody or joint custody. this is how it is in my state and in most states i am sure.
