Custody/Visitation rights for parents that don't pay child support?

I live in North Carolina with my Daughter. Her father lives in New Mexico, I do have a court order for him to be paying child support BUT he is not paying it. North Carolina can not do much because he lives outside the state. My husband and I have no custody agreement or visitation order, so if he is not paying child support and making no effort to come and see his daughter do I have the right to not let him speak to her, see her(which like i said hes made no effort to) UNTIL we do have a custody and visitation agreement????

Thank You for your information. The problem im having is I have gone above and beyond to make sure shes in his life. I even let him stay at my home for 6 days so he could visit with her instead of paying for a hotel, also him and I have made specific times and days that he will call and he never stands by it, he either " leaves his phone in his car all day " , or just didnt feel like waking up at that time to call her, he says we'll skype then never gets on and she crys waiting for him ... I mean when is enough enough!!??

If you do that and he decides to seek full custody than you end up being in the wrong your child support though court ordered has absolutely nothing to do with visitation and access. Your ex just has to show a judge that you are withholding access to his child and the judge may rule in the fathers side of things because it is a firm belief that it is your daughters right to know and have both parents in her life no matter what. Be the bigger person and allow the phone calls. You don't have to facilitate his access you do not have to pay to put her on a plane just be willing to allow him to see her if he makes an effort.
