D.N.A text without mothers permission

Does anyone know if it is against GA law for a father is is only on the birth cert.has never been to court to get right.Is it legal for him to take that child without permission or the mother knowing and get a D.N.A text done??

yes he knows my address he is at my house at lease twice a week.Some how he has done this and it's not right.You see he didn't want me in court because i will tell all the stupid things he has done he can't take care of his self his mom does everything for him he has something wrong with him from a car wreck.He has the mind of a teenager.He can't take care of him for a long period of time like all weekend or even all day.i was out of town one day and he was suppost to pick up r son from school and because he had to work late he left r child at school until 8pm Guess these lawyer don't come cheap do they.,

yeah at the time he took my child and got the D.N.A he hadn't be to court or anything until about a month after the test.

Your first post said the father had never been to court and was only on the birth certificate, but your second one says he HAS been to court, you just didn't get served. Which is it?

Why wouldn't the father know your current address to serve papers to? Apparently if an address isn't known, in some places, it is legal to serve notice through a paper. This may have been the case if you moved somewhere and didn't provide address details.

I agree. You are supposed to sign for those papers when they come or the person that brings them to serve you has to see you in person to serve them and can not give them to just anyone. The papers that are served to someone can not be just left with anyone.

Get a lawyer. The only way the papers can say YOU were served is if you signed for them, so you need a lawyer to fight this.

After he done the D.N.A behind my back he went to court and got joint custody and i didn't even know until after it was all done he had my court papers sent to a address i haven't lived at in over 5 years,The papers i got say i was served and didn't show up for court.So now a man that can't even take care of his self and who has in danger my child many times gets my child for weeks at a time unsupervised just don't know what i can do.

If he's on the birth certificate... he's the legal father and has just as many rights as the legal mother. I do not know specifics in Georgia, but I advise you to speak to a lawyer first thing tomorrow morning and get set up to go to court for custody, visitation, and child support as soon as possible, so there is no guessing game when it comes to your child and his/her rights to a relationship w/ both parents.
