Would I be allowed to go to my sons daycare and pick him up without being on the list but as long as I have his birth certificate? Proffing that I am his mother

I have worked in child care facilities before and in those that I worked in if a parent does not put people on the pick up list, then they can not pick up the child regardless of custody etc. A birth certificate is not going to get you in to get that child nor the fact it shows you are mom. You need to contact the guardian of the child to get on the contact list. But since we do not know what is going on in your case we can not offer any advice but what I do know for a fact: Unless you are listed on pick up lists then you can not get your child.

If there are court orders saying you can't or his primary carer have told them not to release him to anyone other than specified then no.
I don't know the whole story but it sounds like you don't have primary care. If you go against court orders then it's kidnapping.
If I'm wrong then please explain the whole situation so we can actually help.
