Divorce/filing gone bad.....

so my soon to be ex husband and I have recently signed divorce papers back in February. im not sure if he filed them through the court yet since I have yet to receive a finalized divorce decree in the mail. we stay in 2 different cities and we have one child possibly 2 together. Anyways he filed the divorce so I had to review and sign, my son was living with him for this past school year so on the papers it says that we are joint managing conservators with the exception that he decides on the primary residence of our son. well my son is here for the summer, mind you he is only 7, and says that he doesn't want to live with his dad that he wants to live with me until he is old enough to make his own decision....he spoke to his dad and his dad said no that it is his (dad) decision and he said he is going back whether he likes it or not. My son is really hurt he has been crying all day because he wants to come back home with me....what do I do? how can I go about this? please someone help me!!!!!!

I have filled out majority of the papers , but I'm stuck on one. I had a child with another man and he didn't sign the acknowledgement of paternity but he is on her birth certificate, and my husband didn't sign the denial of paternity. Will I have to wait to file until it gets signed?

Go to the court house today and get the papers and file them yourself. Some judges are lenient when it comes to someone representing themselves w/out a lawyer (as in... if you don't get all the legal jargon right they won't hold it against you).

no he never filed the papers. I called and spoke to a lawyer, he said the best thing to do is to fill out the petition and file before he does. so that's what im going to do. I cant afford a lawyer at this moment, and legal aid won't help me because they say its not a divorce concerning threat or fear of the child.

So, he never filed the papers? If he still has the papers, and the courts haven not signed off on them, you are still married. The best thing you can do is get yourself a lawyer.

but what if we never went to court it was supposed to be an uncontested divorce but if he never entered the divorce to the court would I be able to file for a divorce even though he does have the signed papers with him?

Get a lawyer and go back to court. That is the only way to fix it.
