Do I have rights?.....

My brother has never had any part of my nieces life and her mother just passed.Do I as his sister have any legal rights? She's with grandma right now. Can I take guardianship or does grandma have more pull cause she's "grandma"? I have always been a part of my nieces life and even discontinued talking to my brother right after her birth because of his lack of being a man. I know I can give her a stable home and anything she will ever need and more. I have a 5 year old boy who already treats her like a sister. Not that she's not ok at grandmas but I'd like to know if its even a option and do I have any rights?

You are her family but I'm not too sure. You may have to talk with a lawyer or someone that can give legal advice. That is very sad. Hopefully you or G-ma will be able to be caregiver though because who knows if you're brother will ever come around. I really hope he does though.
