Does his dad have legal rights?

If paternity is proven then yes he will have rights, he will be required to help support the child and would also be given visitation in order to help him get to know his child. You have to remember the court doesn't look at it as yours and his rights they look at is as your childs right to know each parent.

Eden: I believe it may vary per state but I'm not sure. I live in TN & when my son was born his father signed the birth certificate. If he hadn't signed it, I'm pretty sure he would have to take a paternity test to prove paternity then ya'll would have to go to court to determine custody & stuff like that. Wish I could be more helpful! I'm with my son's father, although we're not married, but I have wondered ab (heaven forbid!) what would happen if we broke up! Perhaps you could make an appointment with your department of child services, a lawyer, DHS, or even a social worker.
