Does this mean he can keep my son from me with no communication or anything?? The thing is, my child went to spend a week with his dad and when I tried to go pick him back up, he refused to give me my son back... we have a court order saying we are joint conservators but lists ME as having the exclusive right to designate the primary residence of my son, he does not have this right, CAN HE STILL DO THIS TO ME?? I have not seen or heard from my son in 3 months! I've went to his house to try to catch him unannounced to so to speak "steal" my son back but he called the cops and criminally trespassed me from his home where my son is... I'm in the process of taking him to custody court..

Go to court. If the police said they couldn't get involved, then you should have gone to court right away. The judge can issue a warrant and get the child back from the father. However, he may still have visitation and you will have to let him have the child when it's his visitation days. Since he refused to give the child back, maybe you can request the court to change his visitation to supervised so he can't just take off with the child again.

I hope you have evidence of the times you have contacted the police to help you get your child back. Let the judge know that they haven't helped at all.

Sorry lol I didn't know that capital letters means yelling but the police were called three times each time I went over with my court order and they keep saying its a civil matter and that I'm harassing him by calling him and going to his house... its very discouraging ive tried to have cps involved due to the filth that he lives in and the extra curricular activities his dad partakes in in fact on one occasion I showed up as a surprise as I usually did his dad was outside smoking an illegal substance and I told cps this which I should have called the cops then but I was trying to come in peace but he somehow miraculously passed a drug screen the same day... I thank you for your comments I just am trying to get some kind of hope that I can get my child back... I'm in the process of getting a lawyer.

Ok, You didn't say you have been trying to get him back for the 3 months, you only said 1 time.
We don't know what a judge will rule but if he is in contempt of the court orders then it does look better for you. What has your lawyer said about it all? I'm also wondering why the police won't do anything, it is their job to enforce court orders.

Please don't use all capitals either, it looks like you are shouting.

FOR THE LAST THREE MONTHS I HAVE BEEN TRYING TO GET HIM BACK AND HAVE INVOLVED THE AUTHORITIES LIKE I STATED IN MY POST. EVERY TIME I GO TO HIS HOUSE HES NEVER THERE HE DOESNT RETURN MY PHONE CALLS AND THE COPS JUST SAY THAT THEY DONT ENFORCE COURT ORDERS THAT I HAVE TO TAKE HIM TO CUSTODY COURT AND I LEAVE EMPTY HANDED AND I ALSO STATED IN MY POST I WAS CRIMINALLY TRESPASSED FROM HIS PREMISES!! ...MY QUESTION WAS IF I TAKE HIM TO COURT WOULD THEY GIVE ME HIM BACK, AS YOU KNOW JUST BECAUSE YOU TAKE SOMEONE TO COURT DOESNT MEAN YOU WILL WIN... I HOPE THE JUDGE GRANTS ME SOLE CUSTODY ...

If you have court orders stating his visitation and you as the primary caregiver then you need to involve the authorities. What have you done in the last 3 months to get your son back? You should have gone to the police as soon as he refused your son to go with you.
