Drug using Father

I am going thru a custody battle with the father of my 3 month old. The only issues im having is the fact that hes doing drugs when he has him. I tried callin child services and i set up a modification of the custody order but the father has lied and contradicted himself about whether or not hes still using drugs and who our son is around. I tried talking to him about it and he flipped out and stormed out. I dont want to keep my son from knowing his father but i also dont want him to be around the drugs either. Im not sure what im supposed to do.

I don't see why they would take the child out of your custody because of what the father is doing. But you do have to abide by the court order to allow visitation unless you get it changed by the court. If you aren't allowing visitation when it is court ordered that you do so, then yes, they could take the child from you too.

I cant afford a lawyer and I haven't been able to find a pro bono lawyer. The ocy lady said he is allowed to use drugs as long as its not around the child n it doesn't inhibit his parenting skills and if I think its serious enough all they'll do is take him out of both of our custodies.

You will have to prove in court that the father is a danger to the kids. Do you have a lawyer? If not, you should speak to one. If so, what is their advice?
