Go to court. At this point, all you can do is ask. If he refuses, you talk to a lawyer. The court can grant you permission to get a passport, or to travel in specific circumstances. Do you already have any custody papers at all?

So file for full custody. If he cares, he'll show up in court.

With regard to passport, it may not matter whether you have full custody. I have full legal custody of my son, but I still needed to get my son's father to sign the passport application. Otherwise I would have had to get it court ordered that the passport be issues without his signature. It may depend where you live.
