Getting my 2 yr old daughters last name changed.

My daughters father and his girlfriend physically assaulted me about a month ago while my 2 year old daughter was in my arms. My daughter was screaming the whole time and scared to death.A police report was taken, pictures were taken of my injuries and assult charges were pressed and are pending. My daughters father is a convicted felon and has a bad reputation. Here is my question. I would like my daughters last name changed to my last name. She currently has his last name. I don't want my daughter to get a bad reputation when people find out her current last name (his last name). He won't agree to the last name change. Can I go to court and have her last name changed? Do I need a lawyer and do I have a good chance of getting a last name change granted by a judge? I live in Kentucky.

Thank you for your response. I really want her last name changed but I guess she is stuck with it legally until she is 18. Thank you for the info about school. I will keep that in mind when my daughters starts school.

legally you can't get her name changed without his permission until she is of legal age however, you can just change her name and use yours when you register her in stuff. When I register my son at school they asked for his legal name and then on the next line what name does he go by so legally he has his dads last name but he goes by mine all the time and when he is an adult he intends to get it legally changed.
