Grandparent Shared Custody

Although my son had shared custody of my granddaughter, he also had residential custody. He lived with me for nine years after his divorce, my granddaughter has lived with us for the last five years, she is 8 years old now. In April of this year my son was killed. My granddaughter's mother was homeless, so I invited her to live with me. We are on good terms and have always a respectable relationship. I am concerned now that if anything should happen to her mother my granddaughter could be removed from her home of the last five years. My ex-daughter-in-law's family is not in a position financially nor do any of them have any stability to care for her, and they rarely see her. I've discussed this situation with my ex-daughter-in-law and she agrees that it would be best, should anything happen to her, for my granddaughter to stay with me. I am retired, own my own home and have been very active in her school and other outside activities. My son did not leave a will and I am curious as to if a shared custody between my ex-daughter-in-law and myself is something that is possible. I live in Maryland.

My condolences on the loss of your son!

I agree with Dove. As long as the child's mother is in agreement, you should be able to visit an attorney and have paperwork done to cover custody in the contingency of her mother's absence.

Talk to a lawyer, but there shouldn't be any reason in the world that you can't share custody if the mother WANTS to do so. It also shouldn't be a problem for her to get a will and have you named guardian of the child if anything should happen to her.
