Hello! I need custody issue advice or help!? has anyone been through this before? me and my son want to live with my husband, and not be stuck in one spot due to my sons alcoholic father?

I need some help/ advice, if anyone has any information or been through the same thing. I am a mother to my 3 year old son, and doing it alone while my husband is overseas. My sons father gets my son every now and then, and we have no court orders for custody and child support. When my husband is home, we want to be able to move (me and my son) wherever my husband is stationed for his last year in the military. Being that me and my husband are the sole providers for my son, and no court orders can i just take him with us? We also want to try and get full custody so we are able to bring him with us wherever we go, and so his alcoholic/ non-supportive dad cant say anything about it? I need to start the court custody process, but i am scared that the outocme wont turn out good, or that we will have to stay close so my son can still see his dad. Any advice, tips, or help would be extremely appreciated! thanks ladies

that's exactly what I'm thinking. I don't want to risk it with my ex being able to take my son and me not being able to do anything about it. Thanks for the response!

You need to go to court. I'm pretty sure that you can move w/ your son now, but if you do.... his father can take you to court on the basis that you are keeping him away from his son.... which will make you look worse than if you go to court first. You may or may not be able to move. Considering that you are married to this man that you want to move with.... it's likely to be allowed, but you will probably be required to pay (at least half... maybe up to all) for your son to travel to see his father.

There are a variety of circumstances and particular state laws that no one online can give you accurate advice on what WILL happen in your particular situation. The best thing you can do is get a lawyer and ask them.

Just a word of advice.... with no court order... if your ex decides to take off with your son... you will be the one fighting in court to get him back.
