My Daughter Has My last name since she was born. I got married 3 years ago an no longer have my maiden name. Well I just now got an email from my daughters dad stating he wants to change her last name to his. I don't agree with changing her last name and so Im thinking he is going to try and take me to court to change it. My daughter is 10 now and I don't agree with changing her last name since she is older in middle school and plays sports. Also her dad hasn't been a big part of her life and moved 5 hours away and only sees her (or is suppose to see her) 2 nights a month. Has anyone ever had the non custodial parent take them to court to change the childs last name? if so what was the out come??

Definitely get a lawyer, but I can't see a judge ruling to change the last name of a 10 year old if the father is barely involved and the daughter doesn't want the change.

What does your daughter want? I highly doubt they will agree to changing her name at her age if dad isn't involved much, but you might need to let this one run its course. Quite honestly, if she doesn't want her name changed and dad goes ahead anyway, he is totally presenting himself to his daughter as a complete dick.

So he's fighting to change her name but not to spend time with her. I wouldn't worry but you may be better off asking a lawyer.
